Standing Up For Victims Of Defective Hip Implants
Even after potentially deadly problems with metal-on-metal hip designs became known to hip manufacturers decades ago, companies like Stryker and Zimmer have continued to manufacture prosthetic hips that create a metal-on-metal vulnerability. This can lead to dislocation, fracture and the release of dangerous metals into the blood stream, causing a potentially fatal condition called metallosis.
Exposure to these conditions is a far cry from the promise of mobility, improved function and freedom from hip pain that was promised by these companies and their armies of sales representatives at the time of your implant.
If you suspect that you or a loved one was harmed by a defective hip implant, turn to the New Mexico law firm of McGinn, Montoya, Love & Curry. P.A. (MMLC). Our personal injury attorneys have decades of experience in even the most challenging types of cases.
We take pride in representing David against Goliath. We do not believe that big company profits stemming from dangerous products should be tolerated anywhere, and least of all against New Mexicans. Hold the manufacturers responsible for present and future pain and suffering by consulting our qualified lawyers.

Stryker LFIT Anatomic V40 CoCr Femoral Head RECALL
Thousands of patients may be impacted by this recently announced recall involving the Stryker LFIT Anatomic V40 Femoral Head, which connects to a femoral hip stem trunnion. Numerous injuries have been reported stemming from an improper lock between the head and the trunnion. This can lead to corrosion of the metal hip components. This corrosion results in metallic ions being shed into the blood stream. The head is composed of cobalt and chromium, giving rise to the risk of metallosis or metal poisoning.
Signs include: severe pain, loss of mobility, inflammation, periprosthetic fracture, infection, dissociation, dislocation, need for revision surgery.
If you have been implanted with this device, there is a high probability that you will require a revision surgery to remove the head and replace it. If you have received this device, you may receive a letter from your implanting surgeon, but you may also wish to contact your surgeon or a lawyer to inquire whether you received one of these defective Stryker femoral heads. We are happy to investigate your situation and answer any questions regarding your legal rights.
Stryker Rejuvenate Hip Implant RECALL
Although recalled in July 2012, an estimated 20,000 Stryker Rejuvenate modular-neck stems were sold throughout the United States, including to patients in New Mexico. As a result, thousands of patients have been exposed to the potential of metal fretting and corrosion, which results in the release of toxic metal debris into the surrounding tissue and blood stream.
Patients who had a Stryker Rejuvenate hip implant that is subject to the recall in many instances have received a letter from a company called Broadspire Stryker. This company is the third-party claims administrator that Stryker hired to process claims for patients to obtain hip replacements. While time is of the essence, before contacting Broadspire, you may want to consult with a lawyer regarding your rights. Claims made via Broadspire do not include reimbursement for your pain and suffering, lost enjoyment of life, or many of the hardships you and your family have experienced as a result of this defective product.
Litigation to compensate those harmed by this known defective Stryker design is pending in federal and state courts throughout the country. As a New Mexican, you have choices in how to proceed with your claim. As New Mexico attorneys, we would like to be your partners in righting the wrong that has been committed by Stryker.
Please keep in mind that anything you disclose during the Broadspire Stryker claims program could later be used as evidence against you in any Stryker hip recall lawsuit — all the more reason to speak with an attorney before contacting Broadspire.
Zimmer M/L Taper With Kinectiv Technology
Although many nonrecalled models of hips also pose a threat to the health and safety of hip implant recipients, the M/L Taper poses a particularly unique metal-on-metal concern that has led to metallosis in numerous individuals. The M/L Taper design was actually predicated for FDA approval on another hip design known to have metal-on-metal problems.
If you have experienced problems with your Zimmer M/L Taper hip and are interested in information on your legal rights, please give us a call.
Signs Of Hip Implant Failure
Toxic metal fragments from defective Stryker and Zimmer hip implants escape into the bloodstream and surrounding tissue. In some instances, imaging tests, joint aspiration and blood tests can measure the amount of metal in your system. If you have a Stryker or Zimmer hip implant, get tested and monitor your health for these signs:
- Chest pain and shortness of breath, indicating heart trouble
- Numbness, weakness, changes in vision or hearing, signaling nerve damage
- Fatigue, feeling cold and gaining weight, revealing thyroid issues
If you are experiencing any of these symptoms, the attorneys at MMLC can help investigate a potential case against the manufacturer.
Your Time Limit For Filing A Claim
In New Mexico, the right to pursue legal action against a manufacturer is limited to three years. Do not sit on your potential claims. It takes time to investigate and prepare a case, so contact us or another attorney immediately if you think you may have been harmed by this or another defective hip implant.
In some instances, lawsuits against such companies cannot be filed in New Mexico, but instead must be filed in other states with even shorter statutes of limitations. Therefore, it is very important to not delay contact with an attorney who will immediately initiate investigation into whether you have legal claims.
